TERMS & CONDITIONS
These Terms and Conditions, hereinafter referred to as T&C, set forth the conditions that govern the use of the online store on the site www.companhiaatlantica.pt and which the User agrees to comply with, being accessible at any time.
The site owner may, at any time, change in whole or in part, the T&C posted here, and the User is responsible for reviewing them periodically.
1. WEBSITE OWNER

2. USER ACCOUNT
2.1. By registering their user account on the site, the User declares that they agree with the posted T&C, and only after acceptance of these terms can they place their order.
2.2. The User is responsible for using the site in a private and secure manner. We are not responsible for any damage or loss caused by unauthorized access to the user account resulting from the User’s actions.
2.3. CªAtlântica reserves the right to refuse or cancel the registration of any User whenever deemed necessary.
3. PRODUCTS
3.1. CªAtlântica provides detailed information about the characteristics and specifics of the products advertised in the online store, as well as high-resolution photographs illustrating them.
3.2. Due to technological limitations, there may sometimes be slight differences between the advertised photograph and the final product.
3.3. It is recommended to read the descriptions and analyze the product photographs carefully. If there are any doubts, please contact us using the available contact methods.
4. PRICES AND FEES
4.1. CªAtlântica reserves the right to change the prices listed on this site without prior notice; however, we guarantee that the prices presented at the time of the order will be used for billing purposes.
4.2. The prices applied to the products are in Euros and include VAT at the legal rate in effect at the time of purchase, plus shipping costs where applicable.
4.3. Shipping costs are borne by the User and included in the total order amount, which will be communicated to the User at checkout, before making the payment.
4.4. Import duties, taxes, and other fees are not included in the product prices or shipping costs and are the User’s responsibility. We recommend contacting the customs office of the destination country to determine any additional costs before making a purchase.
5. ORDER PLACEMENT
5.1. To place an order online, the User must register on the site by providing the necessary information and filling out all required fields in the registration form. Once registration is complete, a user number will be assigned. Only individuals who are of legal age or legal entities may create an account.
5.2. After completing the registration, the User may place their order online on the site, by accessing their account using the login credentials set during registration.
In case of any technical issues on the site, exceptionally, the order can also be placed via phone or email, using the provided contact details and providing the requested information.
5.3. Regardless of the contact method, we always ensure the implementation of appropriate measures to maintain a high level of security in data processing.
5.4. By initiating an order, the User is making an offer to CªAtlântica to purchase the selected products in accordance with the posted T&C. CªAtlântica reserves the right, at its discretion, to accept or reject any offer made. The acceptance of the order and its confirmation will be communicated via email, after payment confirmation, including the tracking number. If, for any reason, the order is rejected, we will contact you through the most appropriate means.
5.5. At CªAtlântica information regarding stock, prices, and discounts are entered automatically, so if there is any technical issue, you will be informed of the problem and its resolution, such as replacing out-of-stock items with others or correcting the invoice amount.
Whenever the User disagrees with the presented resolution, CªAtlântica reserves the right to cancel the order, with any amount paid up to that point being refunded.
5.6. The order can be canceled at any time as long as it has not yet been shipped. The cancellation request must be made by the User via email, with the subject “Order Cancellation | Order Number”. Subsequently, the amount paid will be refunded.
6. PRODUCT AVAILABILITY
6.1. Products with the status AVAILABLE ON ORDER are not immediately available and may take between 15 to 30 business days for delivery. If the order includes both this type of product and products with the status IN STOCK, it will only be shipped when complete. It is possible to request the early shipment of IN STOCK products by contacting us via email, with the subject “Early Shipment | Order Number”, but additional shipping costs may apply depending on the value of the products and the delivery address.
6.2. Orders are processed according to stock availability. If any of the products are not available in stock, we will contact you as soon as possible via email, informing you of the estimated delivery time. If the User does not agree with the proposed solution, they may cancel the order, with any amount paid up to that point being refunded.
7. PAYMENT METHODS
7.1. To ensure maximum security in payments, CªAtlântica allows payments via PAYPAL, STRIPE (Visa and other payments), and IFTHENPAY (Multibanco payments available only in Portugal).
7.2. If there is any suspicion of fraud or irregularity, CªAtlântica reserves the right to cancel transactions.
7.3. CªAtlântica provides its Users with various payment methods, namely:
– Credit or debit card
When paying with a credit or debit card, the order confirmation is made after the payment is approved by the relevant bank. American Express, Maestro, and all Visa and MasterCard cards verified by Visa as secure payment methods are accepted.
– Multibanco (available only in Portugal)
After finalizing the order, the User will receive an automatic email with the necessary details to make the payment via Multibanco or NET BANKING.
– MB WAY (available only in Portugal)
With MB WAY, the order payment is made quickly and conveniently through the smartphone. For more information about this payment method, please visit www.mbway.pt. If you make the payment using this method, any required refunds will be processed via bank transfer, and the User must provide their IBAN when requested.
– PayPal
One of the most commonly used payment methods for online purchases worldwide. For more information about this payment method, please visit www.paypal.com.
– Google Pay and Apple Pay
With this payment method, there is no need to manually enter card details. In Apple Pay, authentication is done via Face ID, Touch ID, or password; in Google Pay, through the Android device itself.
– Klarna
This payment method is only available for orders with a value equal to or greater than €35. For more information about this payment method, please visit www.klarna.com.
7.4. When applicable, if payment is not made within the stipulated time, or if for any technical reason the amount is refunded to the User’s account, the order will be considered canceled.
7.5. After purchase, an invoice will be sent by email, which will include the breakdown of VAT and any shipping costs, where applicable.
8. ORDER DELIVERY
8.1. Products will be dispatched and sent to the delivery address provided by the User after payment confirmation.
8.2. When a product is indicated as IN STOCK, the time between placing the order and the delivery of the products depends on:
– Delivery Time (4-6 business days)
This period corresponds to the time elapsed between payment confirmation and the pickup of the order by the contracted carrier, which may vary depending on the availability of the product.
– Transportation Time (variable depending on the carrier)
Delivery is carried out by the contracted carrier, so CªAtlântica has no control over the time elapsed during this period. The User will be notified by email when the order is shipped, that is, after acceptance by the carrier.
8.3. Tracking the status of the order should be done directly on the website by logging in and accessing the MY ACCOUNT panel at the icon, under the ORDERS tab, where you will find the link to the carrier’s website. Tracking can also be done directly on the carrier’s website using the tracking number sent earlier by email.
8.4. Whenever the delivery time is exceeded, CªAtlântica will contact you to resolve the situation.
8.5. The User is responsible for ensuring their availability or, alternatively, that of a representative to receive the order at the defined delivery address. If, for any reason, delivery cannot be made, the order will be returned to CªAtlântica and the amount paid will be refunded, excluding any shipping and return costs, if applicable.
9. WARRANTY & POST-SALES ASSISTANCE
9.1. All products are covered by a 1-year warranty, starting from the date of receipt, for manufacturing defects that compromise their functionality and safety. Situations where the User finds that the product is damaged or has some anomaly upon receipt are also covered by this warranty.
9.2. The warranty does not cover damage due to misuse, natural wear and tear, and/or partial or total alteration of the products.
9.3. To activate the warranty, the User must contact us via email or telephone, providing the order number, a description of the defect, and photographs and/or videos that demonstrate it.
9.4. When the warranty is activated, the product may be replaced with a new one of the same reference. In situations where this is not possible, a refund of the amount paid for the product will be made.
9.5. The costs of returning the product under warranty are covered by CªAtlântica.
9.6. If you wish to speak with our customer service team, you can do so through the provided contacts or by sending a message through the contact form available on the website.
10. EXCHANGE AND RETURN POLICY
10.1. If the User is not satisfied with the received product for any reason, they may exchange or return it within 14 business days of receipt.
10.2. For exchanges or returns, the User must contact us via email, using the subject “Exchanges and Returns | Order Number”, and describe the reason.
10.3. To be eligible for an exchange or return, the product must be carefully packaged to avoid any damage during transport and, whenever possible, returned in the original or similar box, and it must not have been used in any way that diminishes its value.
10.4. The condition of the returned product will be assessed upon receipt, and if it is not in compliance, it may be refused or the expected refund amount may be deducted.
10.5. After verifying all the aforementioned conditions, the User will be contacted to proceed with the refund of the amount paid for the products, excluding shipping costs. If the User requests a replacement of the product instead of a refund, they will also be contacted to be informed of the procedure to follow.
10.6. The costs of return, and new shipping if applicable, related to exchanges or returns are borne by the User.
11. LIABILITY AND CONDUCT
11.1. CªAtlântica is committed to providing its Users with all necessary and relevant information about the available products.
11.2. The User agrees to correctly fill out the order forms and provide their details according to the instructions given. CªAtlântica ensures the protection of the provided data, in accordance with applicable legislation.
11.3. The User agrees to pay the amount for the products, including associated taxes and shipping costs.
11.4. It is recommended that the User keeps a copy of all order-related data. CªAtlântica is not responsible for data loss, files, or any other damages resulting from the User’s lack of backup.
11.5. CªAtlântica is not responsible for the consequences arising from the misuse of products purchased from the online store.
11.6. All comments written by customers will be subject to verification by the CªAtlântica team, and comments that constitute a violation of the law or principles of ethics and morality, such as abusive advertising, defamation, insults, among others, may be rejected or edited.
12. PERSONAL DATA PROCESSING
12.1. CªAtlântica is responsible for processing the personal data of Users collected on the site. For information about the processing of Users’ personal data, please consult the Privacy Policy of CªAtlântica available on the same site.
12.2. The personal data provided by the User is essential. In the absence of this information, the order will be automatically canceled.
12.3. By registering on the site, the User agrees to provide valid personal data, which allows the service of CªAtlântica to function, as well as allowing the sending of information and advertising related to CªAtlântica products and offers.
13. INTELLECTUAL PROPERTY
13.1. All content on the site (images, videos, descriptions, trademarks, and others) is the property of CªAtlântica. Duplication of this content, in whole or in part, by any means, must have the prior and explicit approval of CªAtlântica.
14. LAW AND JURISDICTION
14.1. This agreement will be governed by Portuguese and European legislation.
14.2. In case of dispute, the consumer may resort to an alternative dispute resolution entity for consumer disputes (CONSUMER DISPUTE RESOLUTION FUND – Final Consumers):

15. OFFERS
15.1. CªAtlântica occasionally offers promotions such as promotional campaigns and discount vouchers.
15.2. All promotional offers, discounts, and vouchers available on the site have specific values and validity periods, which will be indicated, and are subject to stock availability. CªAtlântica reserves the right to modify or terminate offers at any time without prior notice if deemed necessary.
15.3. Vouchers provided by CªAtlântica are personal and non-transferable, unless explicitly stated otherwise, such as in the case of gift vouchers. Each voucher can only be used once and is not cumulative with other promotions or discounts, unless stated otherwise.
15.4. To use a voucher or promotional code provided by CªAtlântica there will always be a minimum order value stipulated in the ongoing campaign.
15.5. To use a promotional campaign or voucher on the order, the promotional code must be entered in the specific field at checkout. If the promotional code is not applied correctly at checkout, CªAtlântica is not responsible for adjusting it later.
15.6. Some offers may be limited to specific product categories or require a minimum purchase amount to apply. Such restrictions will be communicated along with the terms of the respective ongoing campaign.
15.7. Any attempt at fraudulent use of the available offers, such as using multiple accounts to benefit from the same offer, may result in the cancellation of the order and suspension of the User’s account.
